Judge Delays Trial, Citing Mental Incompetence
Federal District Judge Kenneth Bell has ruled that 35-year-old Decarlos Brown, the man charged with fatally stabbing Ukrainian refugee Iryna Zarutska on a Charlotte light rail train in August 2025, is not currently competent to stand trial because of mental illness.[1][2] The judge found Brown “did not understand the proceedings” and “would be unable to assist in his defense,” a legal threshold that pauses, but does not end, the criminal case.[1][2]
Under the order, Brown will be sent to a federal prison medical facility for up to four months so doctors can try to restore his competency with psychiatric treatment and medication.[1][2] After that period, the court will hold another hearing to decide whether he can finally face trial, whether more treatment is needed, or whether he remains incompetent and must be handled through long-term confinement and possible civil commitment instead of a jury verdict.[1][2]
What Evaluators Say About Brown’s Mental State
A recent federal forensic evaluation, filed under seal but quoted in court, concluded Brown “is presently not competent to stand trial” yet has a “favorable” prognosis for restoration with proper medication.[2][4] Evaluators found he has a serious mental disease or defect, lacks a factual understanding of the legal system, cannot make rational decisions about his case, and cannot work with his defense lawyers because of his condition.[1][4]
Court filings describe disturbing delusions that Brown has voiced for years.[1][5] His attorneys say he believes a “man-made material” was placed in his body and is “controlling his every movement,” a belief he calls his “Body Emergency.”[1][5][7] During the June hearing, reporters say Brown erupted in court, insisting that “someone has full access to my body,” demanding an investigation, and claiming he was “misdiagnosed with schizophrenia” when he tried to explain this “technology.”[2][5]
Defense and Prosecution Both Back Competency Pause
Brown’s own lawyers requested the competency hearing after an earlier evaluation at a state psychiatric hospital found him “incapable to proceed” in the separate state murder case arising from the same killing.[1][6][8] Defense filings say he has “debilitating” mental illness and severe, constant delusions, and argue that under the United States Constitution he cannot legally be tried while he is unable to understand the charges or work with his team.[5][7]
Federal prosecutors in North Carolina did not fight the pause. Instead, they supported the competency process and stressed that Brown will remain locked up while doctors work to restore him.[1][7] One prosecutor said he was “very hopeful” Brown’s capacity could be restored and that the prognosis for getting him trial-ready was “very good,” signaling the government’s intent to still seek full accountability once doctors say the law’s standard is met.[1]
Two Systems, Same Result: Not Competent…For Now
This is now the second time Brown has been found mentally incompetent in connection with Zarutska’s killing.[6] State mental health evaluators and federal evaluators, working separately, each concluded he is not currently fit to stand trial because of mental illness.[6][8] A forensic psychiatrist previously reached the same bottom line, and both state and federal judges have paused their cases to send Brown into treatment rather than into a courtroom.[4][6]

Under federal law, these competency rulings are meant to be temporary, not a free pass. The law treats incompetence as a present-tense question: does the defendant understand what is happening right now, and can he help his lawyers right now.[1][2] If the answer later becomes yes after treatment, prosecutors can still seek the maximum penalty allowed, including the death penalty on the federal “death on mass transportation” charge tied to the light rail attack.[2]
