In its zeal to use executive action to counteract the Supreme Court’s reversal of Roe v. Wade, the Biden administration may be violating one of Congress’ longest-standing provisions against using federal taxpayer funds to pay for abortions.
In an appearance on the Friday episode of the Newsmax show “Spicer & Co.,” Trump administration Secretary of Housing and Urban Development Dr. Ben Carson said the Hyde Amendment is being violated by the government flying illegal aliens across state lines to obtain abortions.
The Hyde Amendment was first passed by the House of Representatives in 1976 and was named for Rep. Henry Hyde (R-IL). It has since come to be known as a general prohibition against the use of federal taxpayer funds to pay for abortion procedures.
It has been a feature of federal budgeting consistently since 1980 and applies except in cases of pregnancy through incest or rape or when an abortion is necessary to save the life of a mother. The amendment was part of the early legislative work done by pro-life lawmakers and advocates after the 1973 ruling by the Supreme Court in Roe v. Wade.
Carson noted that during his tenure in the Senate, Joe Biden was a strong supporter of the Hyde Amendment, even in “cases of incest or rape.” He described the president’s new positions as a “180-degree flip.”
Carson asked if it is fair to taxpayers to be asked to take on the burden of funding abortions with inflation “roaring and the economy going south.” In addition to the payments being against the law, he asked, “Why are we picking up more debt?”
After the Supreme Court ruled on June 24 to reverse Roe in the Dobbs v. Jackson Women’s Health Organization case, the issue of regulating or prohibiting abortion has been returned to the states individually. Thirteen states had previously enacted “trigger laws” that automatically became effective when Roe fell last month.
The Biden administration has since promised to defend the ability of women to travel from restrictive to permissive states in order to obtain abortions. Biden signed an executive order last Friday including provisions facilitating that travel. Under pressure from the radical progressives in his party, Biden is now reportedly considering declaring a “public health emergency” because of the ending of Roe.
Abortion advocacy group National Latina Institute for Reproductive Justice director Lupe Rodriquez said that pregnant women who are illegally present in the U.S. are “likely to face difficulties crossing state lines.” That alleged hardship is the basis for what Carson claimed would be travel funding benefiting illegal aliens in violation of the Hyde Amendment.
Carson added that he is aware that Biden is now planning on having the Department of Justice bring a lawsuit against the State of Texas and Republican Gov. Greg Abbott for “trying to intervene and stop all these people coming in illegally.”
